Legal Requirements for a Wedding in Spain
Spain is a beautiful and culturally rich destination, but legal marriage for foreign couples can be more complex than in some other countries. Understanding the rules and planning ahead is essential for a successful wedding in Spain.
Residency
Legal civil marriages in Spain generally require at least one partner to have been a legal resident in Spain for a minimum of 2 years. This makes it difficult for non resident foreign couples to have a legally binding civil ceremony in Spain.
Church Weddings
A legal Catholic Church wedding in Spain is an option for non residents. These ceremonies are legally binding under Spanish law, but they require approval from the local diocese and submission of religious and civil documentation. The process can take several months and usually requires coordination with both the couple’s home parish and the Spanish church.
Symbolic Ceremonies
Due to the residency requirement, many foreign couples choose to have a legal civil ceremony in their home country or in nearby Gibraltar, and then celebrate with a symbolic wedding in Spain. This offers the flexibility of choosing stunning venues without the legal complications.

“We celebrated our wedding at the Binissatí estate in November, and we couldn’t have done it in a better place. The estate is incredible, it has two areas of forest where you can celebrate the ceremony that are like a movie. In our case we celebrated the ceremony in the bosquet dolç, we had the aperitif and lunch in the Tramuntana area and the party in the cloister. And the truth is that it was perfect. The area of the “bosquet dolç” and the paths that lead to it, have a charm that cannot be explained with words, and for the photo shoot you have spectacular results. The house offers different rooms, so that the bride and groom can dress there, everything is taken care of to the smallest detail. All our guests commented on how perfect this property was to celebrate the wedding. There are many possibilities of configuration according to your tastes and needs, as it has different separate areas but communicated between them. And we could not pass without commenting on the incredible treatment and help of Tomeu, the owner and manager, a very close and nice person, he makes everything easier and makes you feel like you are at home.
